Witcher, et al., and this case raises serious constitutional and due-process concerns. Based on my review, one of the biggest issues is the volume of discovery: approximately 19,000 gigabytes of documents/data. My concern is whether the government, defense, and court meaningfully reviewed the evidence before relying on statements, cooperation claims, and sentencing arguments that helped shape the outcome of the case. This case also raises major Brady/Giglio concerns. If cooperating co-defendants received plea benefits, sentence reductions, sealed agreements, 5K1.1 motions, Rule 35 motions, or any promises from the government, that information should be disclosed because it goes directly to credibility, bias, motive, and impeachment.
